No Prima Facie Case Established in Petitions to Remove Electoral Commissioner and Special Prosecutor – Presidency

The Presidency has announced that no prima facie case has been established in petitions seeking the removal of the leadership of the Electoral Commission and the Office of the Special Prosecutor.

According to a statement issued by government,President John Dramani Mahama, in line with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), referred seven petitions seeking the removal of the Electoral Commission Chairperson and her deputies, as well as three petitions targeting the Special Prosecutor, to the Chief Justice for determination.

The petitions were referred to Justice Paul Baffoe-Bonnie on November 25, 2025, to assess whether they disclosed sufficient grounds to warrant further investigations.

However, in a letter dated January 26, 2026, the Chief Justice informed the President that the petitions did not establish a prima facie case to justify any further action toward the removal of the Electoral Commission leadership or the Special Prosecutor.

The announcement was contained in a statement signed by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications, and released on Wednesday, February 18, 2026.

The statement effectively ends the current attempts to remove the officials, unless new petitions or evidence emerge to reopen the matter under constitutional provisions.
